COURSE OF ACTION
CONTACT: Because every district court, circuit court, and municipal court varies from place to place (such as applicable fines, court costs, and other issues), we need to obtain additional information about your specific criminal charge, dwi, or traffic offense. To do so, please submit your information through our Traffic Ticket Intake Form for speeding/traffic offenses or Criminal Intake Form for misdemeanor/felony offenses or by calling our office at (417) 324-7580.
DISCUSS YOUR CASE: Upon submission, email, or telephone call, our office will then contact you to discuss: (1) the specific charges against you; (2) an overview of the criminal process and expectations; (3) our attorney fee arrangement; and (4) any additional information relevant to your specific circumstances. Depending on the severity of the charge, we may request that you come to our office for an in-person consultation to discuss these matters.
PAYMENT: Once we offer representation in your case, our office has a variety of payment options. You can pay via credit card (either over the phone or using our credit card payment link here) or cash (in person only). For traffic offenses and speeding tickets, we request that you make payment of our attorney fee in full prior to our entry into the case. For all other matters, we understand that money is tight and our office will do our best to accommodate a reasonable payment plan according to the nature of the charge(s) and your financial situation.
ENGAGEMENT: Our representation of you will depend on the type of case and will require a written Representation Agreement. Upon receipt of payment and signed Representation Agreement, our office will then confirm our engagement regarding your case, and will provide you with a receipt for your payment to our office.
REPRESENTATION: During our investigation, we oftentimes find legal issues helpful to your defense. The issues can only be discovered through thorough evaluation of the law enforcements reports, interviews of witnesses, and other defense tactics commonly used by attorney Benjamin A. McBride. After our analysis, we will discuss the strengths and weaknesses of your case, and explore potential plea options. To do so, we will work with the Prosecutor or District Attorney with the goal of arranging a plea, diversion, reduction in charges, or other agreement to resolve your case with the best possible outcome for you. After these discussions, we will then discuss your options, including taking your case to trial and defending your rights or opting for a plea agreement if the risks of trial are simply too great. Each case is different and is extremely factually specific.
